Pennsylvania father Jacob Brooks, 20, says the mother of his child fled to Utah to give birth to their son and illegally put him for adoption. Brooks is now fighting for custody of the 2-year-old boy he has never met.
Brooks and his lawyers spoke to the Utah Supreme Court, arguing that a Utah adoption agency violated his due process and paternity rights by not first getting his consent before placing the boy with another family.
"It's hard not having my son there in my arms," Brooks tells Fox 13 News, "knowing that he's out there somewhere, and I'm not able to see how he is or what's going on with him."
The girl whom Brooks had been dating was a minor and allegedly lied about her age, according to the site. Brooks ended the relationship and later learned that the girl was also pregnant.
While the baby was born in Pennsylvania, the birth mother went to a Utah adoption agency and had him placed with another family without Brooks knowing.
Brooks' lawyers argue that this violated his right to due process. The unnamed adoption agency had no comment.
"I believe sooner or later we will have my grandson," Brooks' stepfather, Chris Konieczny, tells the site. "It's very frustrating to have a grandson out there that you can't hold, can't touch, can't teach him. It's terrible. It's absolutely terrible."
